Legal knowledge worth knowing

CCC s.1516

Key grounds: maintaining or honouring another as a spouse / adultery, gross misconduct, physical or mental cruelty, desertion over 1 year, consensual separation over 3 years, failure to maintain.

CCC s.1523

On divorce for adultery, compensation may be claimed from both the spouse and the third party.

CCC s.1533

On divorce, marital property is divided equally between the spouses.

CCC s.1474

Marital property covers assets acquired during marriage, fruits of personal property, and gifts so designated, doubt is resolved in favour of marital property.

CCC ss.1564 & 1566

Parents must maintain minor children, on divorce, custody follows agreement, failing which the court decides on the child's welfare and benefit.

Relevant Supreme Court judgment

Supreme Court No. 6164/2552, where the other woman knew the plaintiff was the lawful wife yet went on accepting maintenance and being held out as a wife, that infringed the wife's rights, and compensation may be claimed under Section 1523 paragraph two of the Civil and Commercial Code without any want of good faith.
